The Validity of Pertamina's Mixed Fuel Sale and Purchase Agreement from a Sharia Perspective

Abstract

Buying and selling is a form of muamalah based on the principle of mutual need and willingness between the seller and the buyer, the validity of the sale and purchase agreement for mixed fuel oil (BBM) is reviewed from the perspective of Islamic law (sharia). The practice of buying and selling mixed fuel oil (BBM), namely mixing low-quality fuel into high-quality fuel, contains elements of fraud (tadlis) and ambiguity (gharar) which are prohibited in Islamic law. Although in terms of material, mixed oil does not contain haram elements, this practice violates the principles of honesty and transparency so that the sale and purchase agreement is invalid according to Sharia. The research method used is a literature study and qualitative analysis based on the principles of muamalah in Islam, and supported by field data in the form of interviews. This practice also contradicts the principle of maslahah (benefit) and contains dharar because it can damage vehicles and endanger consumers. Therefore, the sale and purchase agreement for mixed fuel is flawed or void because the requirements of transparency and honesty are not met, and contradicts the principle of mutual consent which is the basis for the validity of transactions in sharia. Thus, the sale and purchase of adulterated fuel without the knowledge and consent of the buyer is not valid according to Islamic law and is a prohibited act because it is deceptive and detrimental to other parties.
