Concept of Unconstitutionally Constitutional Amendment by the Constitutional Court to Deter Autocratic Legalism

Abstract

Since 2019 until now, Indonesia is believed to be experiencing symptoms of autocratic legalism as indicated by 3 (three) signs, including first, the ruling co-optation party in parliament; secondly, using law to legitimize the desire for unilateral power; Third, disrupting the independence of the judiciary. This autocratic legalism is caused by the administration of the state which threatens the constitutional rights of citizens. In such circumstances, the only high state institution that can be used as a hope to stem these consequences is the Constitutional Court. This paper analyzes "Unconstitutional Implementation of Constitutional Amendments by the Constitutional Court to Counteract Autocratic Legalism" using a normative juridical method through a comparative approach. The result of this research is to examine the possibility of the inclusion of the Unconstitutionally Constitutional Amendment doctrine within the authority of the Constitutional Court.
